Maryland moves fast at the start. You must tell your employer within 10 days of the injury, by speaking to them or in writing. Then you file a claim form with the Commission within 60 days.
Behind those two dates sits a hard stop. A claim not filed within 2 years of the injury is completely barred, no matter how serious the harm.

Maryland claim deadlines at a glance
- Notice to your employer, oral or written: within 10 days of the injury.
- Claim form filed with the Commission: within 60 days of the injury.
- Absolute limit: within 2 years of the injury or the claim is gone for good.
- Appeal of a Commission decision to circuit court: within 30 days after the Commission's order is mailed.
The appeal clock starts on the mailing date, not the day the order reaches you. Note the date printed on the order as soon as you open it.
Maryland temporary disability checks in 2026
Temporary total disability, paid while you are fully off work and healing, equals two-thirds of your average weekly wage. The Commission's rate notice for calendar year 2026, effective January 1, 2026, sets the maximum at $1,537 a week.
Short absences lose a few days of pay. If your disability lasts 14 days or less, the first 3 days are unpaid.
Once you are out longer than 14 days, that rule no longer applies, so those first days are not lost.

When a Maryland insurer fights your claim
A denial from the insurer is its position, not the Commission's ruling. The Workers' Compensation Commission is where a disputed Maryland claim gets decided and you can reach it at 410-864-5100. If you disagree with the Commission's order, the next stop is circuit court, with the 30-day limit above.
Keep copies of everything: the notice you gave your employer, the claim form, medical notes and every letter from the insurer. Dates on those papers often decide whether a deadline was met.

How a Maryland workers comp lawyer gets paid
Every fee needs Commission approval. On a permanent partial disability award, which pays for lasting harm that remains after you heal, the fee scale allows up to 20% of the first $50,000, 15% of the next $50,000 and 5% of anything above $100,000.
Temporary checks get extra protection. An attorney receives no fee on temporary disability checks unless your right to them was contested. So if the insurer paid those checks without a fight, they stay yours in full.
