Most states send injury disputes to an agency first. Nebraska sends them to a court. If the insurer refuses to pay, you file a petition (the court's word for a lawsuit) with the Nebraska Workers' Compensation Court and the law gives you two years from the accident to do it.
Two more things set Nebraska apart. You get to choose a physician you or your family have already seen as your treating doctor. And when weekly checks run late, the statute adds 50% for waiting time, which gives insurers a strong reason to pay on schedule.

Weekly checks under Nebraska law
If a doctor keeps you from working at all, you are owed two-thirds of the wages you earned when you got hurt. For injuries from January 1, 2026, the court lists the top weekly benefit as $1,166. The floor is $49 a week.
No checks arrive for the first seven calendar days. Pay starts on day eight and if you stay disabled six weeks or longer, the insurer goes back and pays that first week too. For total disability the statute pays during the disability itself, with no fixed number of weeks.

Nebraska time limits for notice, petitions and appeals
- Telling your employer: written notice as soon as practicable after the injury, stating the time, place and cause. Nebraska gives no day count, so do it this week.
- Filing your petition: within two years of the accident. If the insurer has paid some checks, the clock runs from the last payment.
- Appealing a final order of the compensation court: within 30 days.
A petition filed one day late can be thrown out for good. Write the date on paper and keep it where you will see it.
The insurer denied my Nebraska claim
A denial letter is the insurer's position. It is not a decision by the court. You have two tools.
First, anyone in the case can ask for informal dispute resolution, a kind of mediation that the court provides free of charge. The goal is to settle one issue or the whole case, without a formal hearing.
Second, you can file the petition and ask a judge to rule. This is the point where having an attorney matters most, since the petition sets out what you are asking for. Not sure what your letter actually says? Our letter explainer puts it in plain words and our guide to a denied claim covers the usual reasons.
How a Nebraska workers comp lawyer is paid
Nebraska does not set a fixed percentage. Instead, a fee agreement is not binding unless a judge of the compensation court approves it in writing. That review keeps the charge tied to the work done. Before you sign, ask the attorney how the fee is figured and when the judge will see the agreement.

Can my employer choose my doctor in Nebraska?
Only if you do not choose first. The law lets you name a physician you or your family have seen before. Tell your employer your choice in writing.
What happens if my checks keep showing up late?
Payments more than 30 days past notice of your disability can carry a 50% penalty for waiting time. Keep a log of every check date.
